What this book intends to do is to study three-dimensionalism (the distinction values-norms-facts) not in what could be called its historical dimension, but in its substantive aspect, as a "form" that, when applied to different legal themes, would add a "material content" to the three-dimensional theory. La realización de homenajes a figuras apreciadas del mundo académico impone el reto de seleccionar cuál sea el contenido de lo presentado en el evento para que éste se constituya en una auténtica muestra de reconocimiento de sus méritos.En ocasión de la mesa de homenaje a Gregorio Klimovsky, organizada por la Universidad Torcuato Di Tella a instancias de Guillermo Ranea, y convocada en el seno de las XX Jornadas de Epistemología e Historia de la Ciencia, el 26 de noviembre (...) de 2009, en La Falda (Córdoba), Alberto Moretti y Alejandro Cassini, plasmaron la mejor opción. Ambos eligieron analizar tesis filosóficas defendidas por el recordado y querido maestro, tanto en su obra como en las distintas ocasiones de diálogo que mantuvo con pares y discípulos. Se trató de la mejor elección porque de este modo no sólo ambos contribuyen a la difusión de las ideas de Klimovsky sino también, y con gran cuidado analítico, las conjugan con otras doctrinas presentes en el escenario filosófico contemporáneo, destacando así su actualidad y valía. The logical empiricists often appear as a foil for feminist theories. Their emphasis on the individualistic nature of knowledge and on the value-neutrality of science seems directly opposed to most feminist concerns. However, several recent works have highlighted aspects of Carnap's views that make him seem like much less of a straightforwardly positivist thinker. Certain of these aspects lend themselves to feminist concerns much more than the stereotypical picture would imply.

The article examines the new discourse on medical professionalism and responsibility through the prism of conflicts among moral values, especially with regard to truth-telling. The discussion is anchored in the renaissance of English-language writing on medical ethics in the 18th century, which paralleled the rise of humanitarianism and the advent of the word “responsibility”. Following an analysis of the meanings of the value of responsibility in general and in medical practice in particular, it is argued that, similarly to the Aristotelian (...) notion of equity, responsibility of care is a second-order value, which corrects virtues, laws and norms in exceptional circumstances. Virtues and practices of the second order, such as responsibility and deliberation, bear especially on professional doctoring, which includes a commitment to give priority to the good of the patient over one’s own good. It is argued that, in situations of conflict, and particularly conflicts between personal moral identity and the good of patients, the fundamental professional commitment is to critical and rational deliberation and to the cultivation of psycho-moral flexibility. This leads indirectly to moral growth and strengthening of professional character. (shrink)

The article surveys the history of “terror” vis a vis the development of international humanitarian and human rights law. During the French Revolution, the word “terror” was coined to describe a deviation from the laws of war. Justified by a mixture of ideology and necessity. People who resort to terrorism either suspends or rejects the laws of war (jus in bellum) in the name of an alternative and heightened sense of truth. However, the terrorists’ strong sense of probity and mission (...) is also an opening for re-establishing communication, arbitration and mitigation of cruelty and destruction. This paper represents International Humanitarian Law (IHL) as an “abstract Leviathan”, submission to which is the contemporary norm of pacification. From the perspective of radical terrorism, it is tyrannical. From other perspectives, it is open to criticism and change. Most importantly, it is on the side of rational arbitration rather than arbitrary ordeal. Even radical terrorism, which refuses to recognize the legitimacy of the abstract Leviathan, seeks to communicate its radical messages rather than to seek victory my means of physical annihilation of its opponents.
